    Penalties for Marijuana Possession

    Any amount of marijuana found on a person is a crime in Texas and the penalties will depend on the amount in possession. It is also important to remember that penalties are increased in drug-free zones, such as schools or playgrounds.

    Penalties for marijuana possession include:

    • Up to $2,000 and/or 180 days in jail for 2 ounces or less
    • Up to $4,000 and/or up to a year in jail for up to 4 ounces
    • Fines of up to $10,000 and/or up to 2 years in prison for up to 5 pounds
    • For up to 50 pounds, up to $10,000 in fines and/or up to 10 years in jail
    • A similar $10,000 fine and/or 20 years in prison for up to 2,000 pounds
    • More than 2,000 pounds can result in up to $50,000 in fines and/or 99 years in jail

    It is also illegal to possess drug paraphernalia, which includes items used in the growing, harvesting, selling, storing, or use of marijuana. Possession of such material is penalized by a $500 fine.
