    How A First Time DWI Works

    Everyone in the State of Texas is expected to drive well-rested and level-headed. There are legal limits and certain matters concerning consent that everyone must also follow, minors being special cases.

    These legal understandings are as follows:

    • Drivers under the age of 21: can receive a DWI with a BAC of more than .02%
    • Drivers over the age of 21: can receive a DWI for driving with a blood alcohol concentration of .08% or higher.
    • Texas law also states that any individual driving a vehicle has already given consent to a chemical test to determine their BAC. Drivers who refuse to submit to chemical testing can lose their license for up to 180 days.

    Although police should determine the BAC of drivers when they are pulled over or otherwise stopped, criminal prosecutors can still prove drivers are guilty of a DWI if their BAC was taken at a later time. First time DWI offenders can face a minimum of three days of jail time, suspension of their license, fines, and other punishments.
